Privacy Policy

With respect to personal information, Tokyo Commodity Exchange, Inc. (TOCOM) comes across in the course of its business, TOCOM recognizes the importance of protecting such information and shall treat it in compliance with the Personal Information Protection Law and related laws and regulations in the following manner.

This policy shall be made available to the public at all times on TOCOM’s website:

  1. Recognition of importance
    TOCOM deals with various types of personal information through the course of business and recognizes the importance of protecting such information under the Personal Information Protection Law and related laws and regulations.
    TOCOM endeavors to protect personal information in the course of acquiring, utilizing and the management thereof.
  2. Legal and Regulatory Compliance
    When TOCOM deals with personal information through the course of business, TOCOM shall comply with the Personal Information Protection Law and related laws and regulations.
  3. Purpose of Use
    TOCOM shall use personal information solely for the following purposes unless otherwise prescribed in relevant laws and regulations:
    1. Personal Information of Member Representatives and Contact Persons
      To communicate and work with Member Representatives and employees in charge of Exchange matters, and any relevant activities incidental pursuant to these duties.
      The information may also be provided to the regulating ministry, TOCOM Members, or other related organizations.
    2. Personal Information of Customers
      To work on matters in connection with customers of Broker Members, such as: large position management, delivery, requests for reimbursement, claim and dispute resolutions, responses to inquiries and any relevant activities pursuant to these duties.
      The information may also be provided to the regulating ministry, the tax agency, or related organizations.
    3. Personal Information in connection with Registered Sales Representatives
      To work on activities the Exchange provides and manages, such as seminars and qualification exams, and any relevant incidental activities pursuant to these duties.
      The information may also be provided to related associations such as the Commodity Futures Association of Japan.
    4. Personal Information in Connection with Directors and Committee Members
      To communicate and work on meetings of the Board of Directors and the committees, and any relevant activities incidental pursuant to these duties.
      The information may also be provided to the relevant ministry, TOCOM Members, related organizations, or the media.
    5. Personal Information in Connection with Exchange’s Executive Officers and Staff
      To work on the appointment/dismissal of officers, and the recruitment, management of personnel, supervision, disciplinary actions, administrative works related to the Exchange staff, and any relevant incidental activities pursuant to these duties.
      The information may also be provided to health insurance associations, the tax agency and other public agencies, related organizations, or the media.
  4. Proper acquisition
    TOCOM shall not acquire personal information by any improper means.
  5. Disclosure of Purposes of Use
    TOCOM shall make the purposes of use of personal information public via appropriate means such as its website, except as prescribed otherwise in related laws and regulations.
  6. Maintaining the Accuracy of the Information
    TOCOM shall make efforts to keep personal information accurate and up-to-date to achieve the purposes of its use.
  7. Security Measures
    TOCOM shall take safety measures such as supervising employees and business partners for the purpose of preventing mishandling of personal information, including: alteration, destruction, loss or divulgation, etc.
  8. Providing to Third Parties
    TOCOM shall not provide personal information to third parties without consent from the concerned individual, except in the cases provided for in number 3 above or the laws and regulations.
  9. Disclosure Requests, etc.
    When TOCOM receives a request for disclosure of personal information from the concerned individual, TOCOM shall manage the request in accordance with the Personal Information Protection Law.
  10. Compliance with Internal Regulations
    For the protection of personal information, TOCOM shall establish internal regulations, ensure that the Executive Officers and staffs of the Exchange comply with said regulations, and provide relevant training and education.
  11. Inquiries and Complaints
    TOCOM shall respond both appropriately and promptly to inquiries and complaints concerning the handling of personal information by TOCOM, in accordance with the Personal Information Protection Law and regulations prescribed by the Exchange.
